SECTION 1 - NATURE OF SERVICE (INTERMEDIARY MODEL)

This section is of vital importance regarding your legal relationship with us. Please read carefully.

OGUN-SARS SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (trading as Geek Cultcha) acts solely as a commercial intermediary (sales agent) between the Customer and the Supplier/Manufacturer based in Türkiye.

By placing an order on this store, you (the Customer) acknowledge and agree to the following:

  1. Role: We facilitate the transaction by collecting payment and transmitting your order details to the Supplier. We do not manufacture, stock, or physically handle the goods.

  2. Contract: The actual Sales Contract regarding the goods is concluded directly between you (the Customer) and the Supplier/Manufacturer.

  3. Ownership: We are not the owner of the goods at any stage. Title to the goods passes directly from the Supplier to you upon handover to the shipping carrier.

SECTION 2 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.

To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

When you place an order, you are making an offer to purchase. Geek Cultcha reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Geek Cultcha confirms acceptance and transmits the order to the Supplier.

We must receive and process your payment before your order is accepted. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

SECTION 5 - PRICES AND BILLING

Prices for our products are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed.

Unless otherwise expressly stated, posted prices do not include potential customs duties or import taxes applied by the destination country (see Section 6).

You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, and (iii) charges incurred by you will be honored by your credit card company.

SECTION 6 - SHIPPING, DELIVERY, AND CUSTOMS (CRITICAL)

1. Shipping Origin: All products are shipped directly from our manufacturing partner's facility in Türkiye to your address.

2. Importer of Record: As the buyer, you act as the "Importer of Record" for the goods.

3. Customs Duties & Taxes: Since the shipment originates from Türkiye, your local customs office may apply import duties, taxes, or VAT upon delivery.

  • For EU/Global Customers: VAT and Customs Duties are NOT included in the price paid at checkout and are the sole responsibility of the Customer. These charges may be collected by the shipping carrier upon delivery.

We are not liable for shipping delays caused by customs processing or events outside our control.

SECTION 7 - INTELLECTUAL PROPERTY

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, and the design thereof, are owned by Geek Cultcha, its affiliates or licensors and are protected by copyright and intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, or transmit any of the material on the Services without our prior written consent.

SECTION 8 - OPTIONAL TOOLS

Geek Cultcha is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Geek Cultcha (acting as intermediary). By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Geek Cultcha.

Your submission of personal information through the store is governed by our Privacy Policy.

SECTION 12 - FEEDBACK AND USER COMMENTS
